These Terms of Service (“Terms”) govern your access to and use of the Site and any related online features, content, and communications. By accessing or using the Site, you agree to these Terms. If you don’t agree, please don’t use the Site.
1. Services and Eligibility
About JourneyPure Knoxville
JourneyPure Knoxville provides a comprehensive continuum of addiction treatment, including medically supervised detox, residential care, and outpatient programs for individuals and families in East Tennessee. They offer specialized, evidence-based recovery services, including a dedicated residential center for pregnant women, within a supportive and restorative mountain-retreat environment. CLINICAL OR PROFESSIONAL SERVICES ARE PROVIDED UNDER SEPARATE WRITTEN AGREEMENTS, CONSENTS, AND AUTHORIZATIONS. THESE TERMS GOVERN YOUR USE OF THE SITE ONLY AND DON’T REPLACE ANY SERVICE AGREEMENT.
Eligibility
The Site is intended for adults 18 years or older. By using the Site, you represent that you are at least 18 years old, or that you are accessing the Site under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. If you submit information about another person (for example, a family member you’re inquiring about), you represent that you have the authority to share that information for the purpose of the inquiry.
Not Medical Advice
The information provided on the Site is for general informational purposes only. Nothing on the Site is intended to be, and should not be treated as, medical advice, a clinical diagnosis, or a recommendation for any particular treatment. No Provider-Patient Relationship
Use of the Site, submission of a contact or inquiry form, or other communications through the Site don’t create a provider-patient relationship between you and JourneyPure Knoxville. A provider-patient relationship is established only after intake, eligibility verification, signed consents (including any consents required under HIPAA, 42 CFR Part 2, or applicable state law), and acceptance of services consistent with applicable clinical and licensing standards.
Insurance Verification and Pricing Information
Information about insurance coverage, costs, or program length presented on the Site is for general informational purposes only and is subject to change. Coverage depends on your specific plan, benefits, eligibility, level of care, and other factors. Final coverage and out-of-pocket responsibility are determined through verification with your insurance carrier and are not guaranteed by anything published on the Site. Patient billing rights, including any rights under the federal No Surprises Act, are addressed in our separate patient-facing notices and admissions documents.
Confidentiality of Substance Use Disorder Records
JourneyPure Knoxville is a federally assisted alcohol and drug abuse program subject to the confidentiality requirements of 42 CFR Part 2 and HIPAA. Submitting information through the Site doesn’t waive those protections, and our handling of patient records is described in our separate Notice of Privacy Practices.
2. Communications and Acceptable Use
Communications, Calls, and Text Messages
By providing your phone number or email address, you agree that JourneyPure Knoxville may contact you through the methods you’ve provided, including by phone, voicemail, SMS, MMS, and email, for purposes related to your inquiry, account, scheduling, services, billing, and service updates. These communications may be sent using automated dialing systems and prerecorded messages where permitted by the Telephone Consumer Protection Act (TCPA) and applicable state law. Email communications are sent consistent with the CAN-SPAM Act. Message and data rates may apply. You may opt out of marketing text messages by replying STOP and may opt out of marketing emails using the unsubscribe link in any marketing email. Opting out of marketing communications won’t affect transactional or service-related communications that we are required or permitted to send.
Acceptable Use
When using the Site, you agree not to: (a) violate any applicable law, regulation, or third-party right; (b) attempt to gain unauthorized access to the Site, our systems, or any other user’s information; (c) interfere with or disrupt the Site or any associated servers or networks; (d) submit false, inaccurate, or misleading information; (e) upload malware, viruses, or other harmful code; (f) use automated tools, scrapers, or bots to access or extract content from the Site; (g) impersonate another person or misrepresent your affiliation with any person or entity; (h) use the Site to harass, abuse, or harm another person; (i) use the Site or its content to train any artificial intelligence model without our express written permission; or (j) use the Site for any commercial purpose without our prior written consent.
User Content
If you submit content through the Site, including reviews, testimonials, photos, comments, or messages (“User Content”), you grant JourneyPure Knoxville a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, display, distribute, and create derivative works from your User Content in connection with our business and lawful purposes. You represent that you own or have the necessary rights to your User Content, that it doesn’t violate the rights of any third party, and that it doesn’t include identifying information about another person without that person’s authorization. We reserve the right to remove any User Content at our discretion.

Intellectual Property
All content on the Site, including text, graphics, logos, images, audio, video, software, and design, is the property of JourneyPure Knoxville or our licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may view, download, and print pages from the Site for personal, non-commercial use, provided that you keep all copyright and proprietary notices intact. Any other use requires our prior written permission.
Trademarks
“JourneyPure Knoxville” and our associated logos are trademarks of JourneyPure. Other names, logos, and marks displayed on the Site are the property of their respective owners. Nothing on the Site grants you any right or license to use any trademark without the owner’s permission.
DMCA and Copyright Complaints
We respect the intellectual property rights of others. If you believe that content on the Site infringes your copyright, you may submit a notice under the Digital Millennium Copyright Act (DMCA) to our designated agent: Copyright Agent, joshua@divergentdigital.us. Your notice must comply with the requirements of 17 U.S.C. § 512(c)(3). We may remove content alleged to infringe and terminate the access of repeat infringers consistent with our DMCA policy.

Indemnification
You agree to indemnify, defend, and hold harmless JourneyPure Knoxville and its affiliates, officers, employees, agents, and contractors from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Site, your User Content, your violation of these Terms, or your violation of any law or third-party right.
Force Majeure
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms that is caused by events outside our reasonable control, including acts of God, weather, natural disasters, pandemic, internet or telecommunications outages, or government action.
5. Legal Disputes and Agreement
Governing Law and Venue
These Terms are governed by the laws of Tennessee, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site that isn’t subject to arbitration will be resolved exclusively in the state or federal courts located in the county of our principal place of business in Tennessee, and you consent to the personal jurisdiction of those courts. Nothing in this section limits any right you may have under the laws of your state of residence that cannot be waived by agreement.
Dispute Resolution
Before filing any formal claim, you agree to contact us at joshua@divergentdigital.us and attempt in good faith to resolve the dispute informally. If the dispute cannot be resolved within 30 days, either party may pursue formal proceedings consistent with the Governing Law and Venue section above.
Termination
We may suspend or terminate your access to the Site at any time, with or without cause and with or without notice, including if we believe you’ve violated these Terms. Upon termination, all rights granted to you under these Terms cease, and provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution, will continue to apply.
Changes to These Terms
We may update these Terms from time to time. When we do, we’ll revise the “Last Updated” date above and post the updated Terms on the Site. Material changes will be communicated through a notice on the Site or other reasonable means. Your continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
Severability and Entire Agreement
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with our Privacy Policy, our HIPAA Notice of Privacy Practices, and any service agreements you sign with us, constitute the entire agreement between you and JourneyPure Knoxville regarding your use of the Site.
